How Are Offenders Referred To Drug Court ?

An offender can be referred to the Drug Court program in several ways.

 
1. An 18 year or older South Dakota resident is arrested for a felony or possession of a controlled substance related crime or violates their probation. The offender must be within the jurisdiction of the Fourth Judicial Circuit.
 
2. Is approved for Drug Court by the State’s Attorney.
 
3. An application is made to the Drug Court program by an offender who is willing to accept responsibility for the offense.
 
4. The offender is evaluated for a methamphetamine or possession of a controlled substance abuse disorder by Northern Hills Drug and Alcohol Services.
 
5. The applicant is screened and voted upon by the Drug Court Team for appropriateness for the program.
 
6. The state’s attorney, offender’s attorney and offender will be notified of the offender’s acceptance or rejection into the Drug Court program.
 
7. If accepted, the offender pleads guilty to the felony and is sentenced to Drug Court as a condition of probation.
