How Are Offenders
Referred To Drug Court

An offender can be referred to the Drug
Court program in several ways.

| 1. An
18 year or older South Dakota resident is arrested for a felony or
possession of a controlled substance related crime or violates their
probation. The offender must be within the jurisdiction of the Fourth
Judicial Circuit. |

| 2.
Is approved for Drug Court by the State’s Attorney. |
| |
| 3.
An application is made to the Drug Court program by an offender who is willing to
accept responsibility for the offense. |

| 4.
The offender is evaluated for a methamphetamine or possession of a controlled substance
abuse disorder by Northern Hills Drug and Alcohol Services. |

| 5.
The applicant is screened and voted upon by the Drug Court Team for appropriateness
for the program. |
| |
| 6.
The state’s attorney, offender’s attorney and offender will be notified of the offender’s
acceptance or rejection into the Drug Court program. |

| 7.
If accepted, the offender pleads guilty to the felony and is sentenced to Drug Court
as a condition of probation. |
