UJS Boards and Commissions

The following is a list of state-level judicial boards and commissions in South Dakota. Membership of these boards and commissions are comprised of judicial officers from South Dakota courts, other state agency staff, attorneys, members from other professions and the public. 

The Commission on Equal Access to Our Courts provides grants to nonprofit entities that are funded, or nonprofit entities contracting with nonprofit entities that are funded, by the Legal Services Corporation and deliver legal services to persons meeting income eligibility guidelines.

The Commission on Indigent Legal Services oversees indigent legal services in South Dakota’s court system where there is a right to counsel under state or federal law. The Commission also oversees the Office of Indigent Legal Services to provide statewide indigent representation services in appeals of criminal, habeas corpus, and abuse or neglect of a child cases.

The Commission on Parenting Time Guidelines is formed every four years for the duration of one year to review the standard parenting guidelines outlined in SDCL 25-4A-10 and report its findings and recommendations to the Supreme Court, Governor, and the Legislature no later than October 1 of the year in which it is appointed.

The Council for the Interstate Commission for Juveniles ensures that adjudicated juveniles and status offenders subject to the Interstate Compact are provided adequate supervision and services in the receiving state as ordered by the adjudicating judge or parole authority in the sending state; ensures that the public safety interests of the citizens, including the victims of juvenile offenders, in both the sending and receiving states are adequately protected; returns juveniles who have run away, absconded, or escaped from supervision or control or have been accused of an offense to the state requesting their return; makes contracts for the cooperative institutionalization in public facilities in member states for delinquent youth needing special services; and provides for the effective tracking and supervision of juveniles.

The Court Appointed Special Advocates Commission makes awards through the grant program and performs related functions to the state's CASA programs. CASA programs provide a service to the court that oversees child abuse and neglect cases and to the children involved in the court proceedings.

The Drug Court Advisory Council is responsible for monitoring and reporting performance and outcome measures for South Dakota Treatments Courts. The Council's goal is to work toward ensuring all South Dakota Treatment Courts are operated in a manner that produces the best outcomes for the participants while remaining cost effective.

The Judicial Qualifications Commission investigates and holds hearings on complaints against any justice or judge and censure, remove or retire a justice or judge if warranted. The Commission also makes recommendations to the Governor for judicial appointments.
