Why Give Back?

Providing legal assistance to those who cannot afford an attorney and with nonprofit organizations helps ensure that all individuals have equal access to legal services. Not only is it beneficial to serve your community, but it is also part of an attorney's professional obligation. Additionally, it helps with recruitment efforts, helps young attorneys build skills, assists in building networks and provides recognition to South Dakota's attorneys. When you do pro bono, everybody wins.

Dakota Plains Legal Services

Dakota Plains Legal Services (DPLS) is a nonprofit legal services organization that provides free legal assistance to low-income individuals, older Americans and veterans. DPLS has eight offices and serves communities across South Dakota and North Dakota, including nine tribal nations.

Through its Private Attorney Involvement program, DPLS contracts with private attorneys in South Dakota and North Dakota to help deliver legal services to its low income clients. Cases contracted with private attorneys are primarily in the areas of Indian law, family law, consumer law (including a limited number of bankruptcy cases) and cases in which domestic violence is a factor.

East River Legal Services

East River Legal Services (ERLS) provides legal assistance focused on transforming the lives of impoverished and mistreated individuals in eastern South Dakota. The nonprofit civil legal aid office gives preference to the elderly (60+), people experiencing homelessness, veterans, LGBTQIA+, limited English proficiency, victims of violence and people with disabilities.

ERLS relies on the support of donors and volunteers to help close the justice gap in South Dakota. Volunteer attorneys help clients with a variety of legal issues on a pro bono basis. The agency specializes in family law, housing law, public benefits and consumer law. 

Access to Justice Opportunities

The State Bar of South Dakota formed Access to Justice (A2J) to make legal services accessible to all South Dakota citizens. A2J provides legal services to individuals living at or below 125% of the federal poverty guidelines; survivors of domestic violence, sexual assault, human trafficking or stalking living at or below 150% of the federal poverty guidelines; and individuals with disabilities, the elderly and veterans who live at or below 200% of the federal poverty guidelines.

Access to Justice (A2J) offers pro bono and reduced-rate service opportunities to South Dakota attorneys that are a member in good standing with the State Bar of South Dakota. Reduced-rate service opportunities are provided through A2J judicare and A2J modest means cases. 

Judicare case opportunities provide the attorney with a one-time, reduced-rate payment for volunteering for the A2J judicare case. Payment for judicare cases is made to the attorney through A2J judicare funding.

Modest means case opportunities are client-paid, and the attorney volunteering for the case agrees to handle the case at the reduced modest means hourly rate ($100 per hour) and retainer cap ($650 per retainer). If the initial modest means retainer is exhausted, the attorney may request additional modest means retainers from the client (also $650 each) until the matter is complete. All modest means billing and payment is handled through the attorney’s office.

*Attorneys interested in A2J reduced-rate case opportunities are encouraged to first volunteer for a pro bono case through Access to Justice.
