Electronic Filing

South Dakota provides for attorney's and self-represented litigants to complete and file court documents electronically. It is encouraged before any user utilizes the electronic filing system, that they review the South Dakota Rules on Electronic Filing SDCL 15-26C. The electronic filing options available below are for users to file a new action or an existing case only. If you are needing to review your case of filings or upcoming hearings you can create a free account on South Dakota's eCourts website. 

E-Filing for Attorneys

eFileSD is a program offered by Tyler Technologies for registered attorneys and law firms to initiate a new action or filing into an existing case. 

E-Filing for Self-Represented Litigants

Guide and File is a program offered by Tyler Technologies for self-represented litigants to complete interviews for certain case types that will generate completed forms to e-file or print and file in person with the Clerk of Court. 

Frequently Asked Questions

If you are not represented by an attorney, no, it is not required to file electronically, and form can still be filed in person with the clerk of court. 

If you are an attorney, you are required to electronically file all documents, including petitions, notices of review, motions and briefs, and any appendices with the Supreme Court through the Odyssey electronic filing system unless advance permission is granted by the court allowing paper filing or filing through any other method SDCL 15-26C-1.

Yes. If you are starting a new case, you will be required to pay a filing fee. 

If you are a self-represented litigant and are using the Guide and File system, you can email UJS staff at ujssrlhelp@ujs.state.sd.us.

Registered attorneys who are filing in eFile can email UJS staff at UJSeSupport@ujs.state.sd.us. 

You will receive an email notification associated with an envelope number. The Clerk of Court will review your filing and will either accept or reject your filing. If your filing is accepted, you will receive an email that your filing has been accepted, and your credit card will be charged at that time.

Simply log back into your guide and file account and select the interview that was rejected, make the necessary corrections and resubmit.
