Transforming Lives Through Treatment Courts

Treatment courts are the most effective intervention for helping individuals with substance use and mental health disorders transition from the criminal justice system into lives of recovery, stability, and contribution. In South Dakota, these courts—collectively known as treatment courts—include Drug Court, DUI Court, Veterans Court, and Mental Health Court.

Within treatment courts, a collaborative team works together to guide participants toward success. Treatment providers develop personalized, evidence-based plans to address each participant's unique needs, while probation officers offer consistent community supervision. Judges, law enforcement, defense attorneys, prosecutors, and other team members combine their expertise to ensure accountability, provide structure, and deliver ongoing support. Through regular evaluations, status hearings, and substance use screenings, the team provides accountability, fostering an environment where participants can achieve lasting change.

2026 National Treatment Court Month

May is National Treatment Court Month and the perfect time to share the many ways treatment courts are making a positive impact on their communities. South Dakota’s treatment courts have planned uplifting events to recognize individuals whose lives have been transformed by the treatment and support provided by these programs. 

Treatment Court Goals

  • Reduce substance use and recidivism among targeted participants.
  • Enhance public safety by integrating the criminal justice system with treatment services and community resources.
  • Minimize reliance on incarceration for addressing substance use disorders.
  • Empower participants to work, parent, and thrive as active members of the community.

Problem-solving courts were created to solve a unique and expensive problem within the criminal justice system. The 2020 Problem-Solving Courts Annual Report provides a snapshot of court operations during a very unusual year.

South Dakota currently has ten drug courts, including two drug courts with a DUI track. This program evaluation looks at national best practices and standards, recidivism rates of participants after exiting drug court, and the costs associated with the South Dakota drug court program.
